Terms of service.

  1. Hourly Rate & Adjustments

    Standard Hourly Rate MTR Electrical's standard hourly rate is $120 + GST per man hour.

    Rate Adjustments

    MTR Electrical reserves the right to adjust its hourly rate at any time in response to changes in material costs, labour market conditions, regulatory requirements, or other external factors. Any updated rate will apply to all works performed from the effective date of the adjustment, overriding any previously quoted or agreed rate.

    Application of Rate Adjustments

    Unless otherwise agreed in writing, all work performed—including quoted works, variations, and additional services—will be charged at the current hourly rate at the time the work is undertaken.

    Quote Validity

    Unless otherwise stated, all quotations are valid for 30 days from the date of issue.

    Payment Terms

    Preferred Payment Terms 7 days. We will however accept up to 30 days end of month terms with prior arrangement.

  2. Invoicing and Progress Claims

    Small jobs under $10,000.00 will be charged at MTR Electrical’s discretion either progress claims as the job proceeds or in full at the completion of the job.

    Jobs over $10,000.00 will be invoiced as monthly progress claims based on the percentage of the job completed at MTR Electrical’s discretion.

    If progress invoices are not paid on time, MTR Electrical will not return to site to continue works. If this occurs, we will not be held liable for missed works or damage caused to complete works due to non-payment delays. MTR Electrical, at its own discretion, may also charge a variation if works take longer than what was allowed due to non-payment days.

  3. Invoice Disputes

    Any invoice disputes must be raised within 10 business days of the invoice issue date.

  4. Payment Claims

    Under the Building and Construction Industry Security of Payment Act, the Builder has 10 business days to respond to a Payment Claim. Should the Builder wish to dispute the Payment Claim, they Page 1 must issue a Payment Schedule within this timeframe. If the Builder fails to do so, the Payment Claim is deemed to be accepted, and the Builder loses the right to dispute the claim.

  5. Variations Once the Project Has Commenced

    Variations/changes will be written up onto a variation document; each variation needs to be signed and returned before we proceed. Each variation form will incur an admin fee of $100.00 + GST.

    The hourly rate for variations is provided alongside each variation quote, as referenced in the accompanying Terms & Conditions document.

    If changes are made to the plans by architects, engineers, interior designers, or draughtsmen, it is expected that they will bubble the change and notarise the change at the bottom of the plans with a brief description and date change was made.

    It is also expected that when a plan or specification update is issued, a brief summary of changes is also issued to notify MTR Electrical as to what has been updated. We are not responsible for cross-referencing and reviewing all project documentation with each amendment to find the changes.

    If this is not performed by the appropriate person, MTR Electrical may charge an additional admin fee for works required to find and detail these changes which were not made clear on the drawings.

  6. Onsite Changes and Alterations

    If the client or builder discusses any changes or alterations onsite, it is required that these changes are communicated to our office for formal approval. It is the builder's/client's responsibility to send these through to our office for formal approval. No MTR Electrical employee has the authority to approve any changes onsite unless specifically instructed to do so.

  7. Builders Please Note Regarding Variations

    We recommend that before the commencement of a project, the Builder, Client, and the electrician sit down and discuss/go through the electrical drawings in detail to make sure all items are covered for the client. This helps to minimise the variations as the project progresses and will also help the project run smoothly.

  8. Sub Contractors Requiring Electrical Connections

    MTR Electrical advises that all subcontractors requiring wiring or connections by us must provide us with the appropriate electrical specifications and wiring diagrams. MTR Electrical will not chase subcontractors for these details. If these details are not provided to us, we may charge a variation for the works on top of the contracted price.

  9. Warranties

    MTR Electrical will rectify any defects in materials or workmanship within 12 months of the installation/project completion date. Any defects appearing in the work caused by improper use, Page 2 third-party modifications, vandalism, or improper maintenance that does not meet the manufacturer’s specification are subject to exclusion at our discretion.

  10. Drawing and Plan Discrepancies

    While we take all reasonable care in compiling and cross-referencing architectural, consultant, interior, and landscape designer drawings, we do not assume responsibility for this task. It is not our role at the tender stage to identify or address discrepancies between these drawings, nor to bring these to the attention of architects or project managers. MTR Electrical will not be responsible for rectifying design issues, as it is the responsibility of the architects and designers to thoroughly review all drawings before they are issued for tender, ensuring that all details are accurate and complete. Our quotations are carefully itemised to reflect all components included. If any items are missed due to discrepancies in the drawings, we will not be liable for the associated costs and will issue a variation as needed.

  11. Defective Work / Back Charges

    In the event of any disputes regarding defective work, back charges, or repair costs, formal written notice must be provided, including a detailed list of defects or back charges. Upon receipt of formal notice, MTR Electrical Solutions shall be granted a period of 60 days to rectify the issues before any back charges are applied. Additionally, any back charges must be agreed upon in writing by MTR Electrical Solutions prior to being applied to any invoice.

  12. Materials Clause

    MTR Electrical Solutions reserves the right to adjust the cost of materials for projects in response to supplier price increases. If this does occur, we will provide written documentation of the cost increase and raise a variation reflecting this adjustment.

  13. Working Hours

    Our standard working hours are Monday to Friday, 7:00 am - 4:00 pm. We have made no allowance for work outside of these hours unless specifically noted in our quotation. This quotation also excludes overtime due to accelerated project schedules or delays caused by others.

    If the customer requires the company to perform services outside of the nominated hours, the quote will be increased to reflect award penalty rates for that part of the services performed outside of those hours.

  14. Customer Supplied Parts & Light Fittings

    If the customer supplies their own light fittings and parts for any project, the company assumes no responsibility for any issues related to these items. This includes, but is not limited to:

    14.a Incorrect Items Ordered: The customer is solely responsible for ensuring that the correct items are ordered. The company will not verify the suitability, compatibility, or correctness of customer-supplied parts.

    14.b Change of Mind: The company will not facilitate the return, exchange, or refund of any customer-supplied items if the customer changes their mind about the purchase or use of these items.

    14.c Defective or Damaged Items: The company will not be responsible for any defects, damage, or malfunctions in customer-supplied items, nor will it be responsible for the performance or warranty of these items.

    14.d Follow-Up on Issues: The company will not follow up with suppliers or manufacturers regarding any issues with customer-supplied items, including but not limited to, obtaining replacements, repairs, or refunds.

    14.e Installation Risks: The company will not be liable for any additional costs, delays, or damages arising from the installation of customer-supplied items. The customer acknowledges that any issues arising from the use of these items, including installation complications or project delays, are the sole responsibility of the customer.

    14.f Delivery & Organisation of Customer-Supplied Items: We will not handle or facilitate the delivery and organisation of any customer-supplied light fittings to or onsite. It is the responsibility of the customer or person supplying the light fittings to organise and arrange these fittings onsite, including clearly labelling and grouping the fittings for the locations they are to be installed. If MTR Electrical is expected to do this, a back charge may apply for the time spent.

    All invoices are claimed under the Building and Construction Security of Payment Act 2022.
